Removing Violations from Your Driving Record

As a CDL driver, getting violations can cost you and your trucking business both time and money. If you’ve received a ticket in the past, there may be ways to get the points removed from your driving record. Orange & Black Has Your Back! Below are a few things to expect if you attempt to remove points from your driving record.:

  1. Consult an attorney- we cannot offer legal advice, but a licensed attorney can! If you want to start the process, research attorneys that can help with your specific ticket. Ask for recommendations, look at your state’s legal directories, or contact a local bar association.

  1.  Contesting the Ticket

  1. Review the Violation: Understand the nature of the violation and check the details on the traffic ticket. Ensure all information is accurate.

  1. Request a Hearing: Submit a request for a court hearing by the deadline specified on the ticket. This usually involves filling out a form or contacting the court directly.

  1. Prepare Your Case:

  1. Gather Evidence: Collect any evidence that supports your case, such as photographs, videos, witness statements, or any documents that may help prove your innocence or explain the situation.

  1. Review the Law: Understand the specific traffic law you are accused of violating and identify any possible defenses.

  1. Witnesses: If applicable, arrange for witnesses who can testify on your behalf.

  1. Court Appearance: Attend the hearing to present your case. Be punctual, dress appropriately, and be respectful to the court. If you provide your own testimony, be prepared for the possibility that the judge or prosecution may ask you additional questions for clarity about your testimony.

  1. Judgment:

  1. Dismissal: If the court finds in your favor, the ticket may be dismissed, and no points will be added to your driving record.

  1. Guilty Verdict: If you are found at fault, you may have to pay fines, and points will be added to your driving record. However, you can still explore other options such as expungement.

  1. Expungement

  1. Check Eligibility: Verify if you are eligible for expungement under your state’s laws. This typically requires having a clean driving record for a specified period after the violation.

  1. Application for Expungement:

  1. Form Submission: Complete and submit an expungement application form to your state’s DMV or the court that handled your case.

  1. Supporting Documents: Provide any required supporting documents, such as proof of completion of any court-ordered programs or a copy of your driving record.

  1. Approval: If approved, the violation will be removed from your driving record, and any associated points will be erased.

In the best-case scenario, you wouldn’t receive a ticket or a violation, but anyone can make mistakes. If you have received a violation, consult with an attorney to protect your business and yourself.
